Further to our correspondence of March 14th, addressed to the Scarborough Community Council under Section 34 of the Planning Act, I acknowledge receipt of the Decision Report – Refusal.

It arrived on a Tuesday. The envelope was heavier than I expected. The planner’s signature was a cold, looping blue ink. I unfolded the pages and found the reasons stamped and sealed. The Director of Community Planning, Scarborough District, had spoken.

Schedule A shows the rear-yard dimensions. The required fire truck turning radius intersects precisely with the drip line of the existing oak tree. The roots hold every reason why.

I conducted a site inspection with the report in hand. The tree has been there longer than any of us. Its canopy extends past where the pavement would go. The shadow is non-conforming, six feet deep. I sat beneath it and wept a little. Or a lot.

The report cites inconsistency with the Provincial Policy Statement and non-conformity with the Official Plan. The Tall Building Design Guidelines don’t lie. Neither does the oak tree.

I could appeal to the Ontario Land Tribunal. I will. But today I’m just a person standing in a backyard with a carbon-copied death warrant, holding a single power chord in my heart.

The laneway suite was supposed to be noble. A persecuted housing typology given form. Now it’s just a survey stake and a pile of unpainted drywall propped against the fence.

This is not the end. Notices of continuance will be filed. The Community Consultation Meeting is over, but my kitchen sink still sees statutory gatherings every morning. I’ll read Chapter 150 again, the part about secondary suites—45 percent of floor area, one parking space. They never talk about what happens when the tree takes the dwelling’s place.
